Welcome to Sweet Success Lifestyle Transformations ("Sweet Success," "we," "our" or "us"). These Terms of Service ("Terms") govern your access to and use of sweetsuccess.ca and any associated sub‑domains, mobile applications, landing pages, digital downloads, quizzes, SMS/text message programs and other services we provide (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Acceptance of Terms

By accessing, browsing, submitting information to, or otherwise using the Services, you ("User" or "you") acknowledge that you have read, understood, and agree to be bound by these Terms and to comply with all applicable laws and regulations.

2. Description of Services

Sweet Success provides:

• Educational wellness content, including articles, videos, webinars and downloadable guides;
• Cellular‑nutrition coaching programs such as Vitality180;
• Sales of Immunocal and other wellness products as an authorized Immunotec consultant;
• Email  newsletters and promotional SMS notifications (see Section 5);
• Interactive tools and quizzes designed to help Users evaluate their health or business goals.

We reserve the right to modify, suspend or discontinue any part of the Services at any time without notice

3. Eligibility & User Conduct

• You must be at least 13 years of age (or the age of digital consent in your jurisdiction) to use the Services.
• You agree not to: (a) upload or transmit any viruses, malware, or other harmful code; (b) harvest or scrape content or personal data; (c) use the Services for any unlawful, obscene, or abusive purpose; (d) attempt to gain unauthorised access to any portion of the Services.
• We reserve the right to suspend or terminate your access for any violation of      these Terms.

4. Medical & Wellness Disclaimer

All information provided through the Services is for educational purposes only and is not intended to diagnose, treat, cure, or prevent any disease. Always consult a qualified healthcare professional before making changes to your diet, exercise routine, supplementation, or health regimen. Individual results may vary. Reliance on any information provided by Sweet Success is solely at your own risk.

5. SMS/Text Message Program Terms

When you opt in to our Sweet Success SMS Updatesprogram:

• Frequency: Up to 4 promotional messages per month (frequency may vary based on engagement).
• Cost: Message & data rates may apply.
• Opt‑Out: Reply STOP at any time to cancel. You will receive one final      confirmation text.
• Help: Reply HELP for assistance or email judy@sweetsuccesslt.com
• Consent  Not Required for Purchase: Your consent to receive marketing texts is not a condition of any purchase.
• We  retain documented proof of your express written consent (time stamp, IP      address, form screenshot) for at least four (4) years to comply with carrier 10DLC, TCPA (U.S.) and CASL (Canada) requirements.

6. Digital Products, Purchases & Refunds

• Pricing  & Payment: All prices are listed in Canadian dollars (CAD) unless stated otherwise. Applicable taxes will be charged in accordance with Canadian law.
• Refund      Policy: Physical products may be returned within 30 days of delivery in original condition for a full refund, less shipping. Digital products and coaching fees are refundable within 7 days of purchase unless otherwise specified.
• Chargebacks: Initiating a chargeback without first contacting us to resolve the matter      may result in immediate termination of access to the Services.

7. Intellectual Property

All content on the Services—including text, graphics, videos, quizzes, PDFs, trademarks and logos—is the property of Sweet Success or its licensors and is protected by Canadian and international copyright and trademark laws. You are granted a limited, non‑exclusive, non‑transferable licence to access and use the content for personal, non‑commercial purposes. Any other use—including reproduction, distribution, modification, or public display—requires prior written permission from Sweet Success.

8. Third‑Party Links & Resources

The Services may contain links to third‑party websites or resources. We are not responsible for the content, products, or services on those sites. A link does not imply endorsement. You acknowledge sole responsibility for, and assume all risk arising from, your use of any third‑party websites.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR‑FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWEET SUCCESS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; (C) UNAUTHORISED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (I) CAD $100 OR (II) THE AMOUNT YOU PAID TO SWEET SUCCESS IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless Sweet Success and its affiliates, officers, directors, employees and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including reasonable legal fees) arising from: (a) your use of and access to the Services; (b) your violation of any term of these Terms; or (c) your violation of any third‑party right.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of laws principles. Any dispute arising out of or related to these Terms shall be resolved by binding arbitration under the ADR Institute of Canada Arbitration Rules in Calgary, Alberta, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction. You waive any right to participate in a class action or class‑wide arbitration.

13. Modifications to Terms

We may revise these Terms at any time. We will post the updated version with a new "Last updated" date at the top of this page. Changes are effective immediately upon posting. Continued use of the Services after changes constitute acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

15. Entire Agreement

These Terms, together with the Privacy Policy and any additional legal notices published on the Services, constitute the entire agreement between you and Sweet Success concerning the Services and supersede any prior agreements.
